Job Announcement: Office Administrator/Litigation Assistant

We seek a sophisticated and experienced Office Administrator/Litigation Assistant with a desire to provide administrative and litigation support in a face-paced, but congenial, small firm setting. Job Duties:
-Prepare and file legal documents at local courthouse and electronically;
-Prepare Tables of Contents & Tables of Authorities for legal documents;
-Manage electronically-received legal pleadings and document production, including medical authorizations and medical record production;
-Manage event planning, marketing, and large-scale mailings in collaboration with Managing Partner;
-Manage intakes and conduct follow up phone calls with potential clients in collaboration with Paralegal;
-Calendar legal deadlines and attorney appointments;
-Make travel, deposition, process service, and similar arrangements;
-Maintain system of client codes and cost-tracking for photocopier and postage accounts;
-Manage and prepare closed-cased files for off-site storage;
-Limited data entry of attorney time records;
-Attend and participate in bi-weekly litigation and staff meetings;
-Oversee office equipment service and maintenance;
-Meet and greet clients and office visitors; and
-Supervise Law Clerk.

Requirements:
-4-year degree and office administration experience;
-Experience supervising administrative staff;
-Exceptionally organized and focused with utmost attention to detail;
-Superb written and oral communication skills;
-Experience and comfort with MS Word, MS Excel, and Adobe/PDF files.
-Ability to prioritize and multi-task; and
-Highly motivated to play a key supportive role, including some basic administrative tasks, in a social justice-driven law firm.

Preferred But Not Required:
-Experience working in a law firm helpful, but not required;
-Bilingual English-Spanish written & oral fluency highly desired.

Seasoned Employment Law Attorney Lauren Teukolsky Joins Baltodano & Baltodano LLP as Partner

Baltodano & Baltodano LLP is pleased to announce that Lauren Teukolsky has joined the firm as Partner.

For the last four years, Ms. Teukolsky was a Partner at Traber & Voorhees in Pasadena. Before that, she served as the Pro Bono Director at Bet Tzedek Legal Services and spent eight years as an associate at Hadsell Stormer & Renick LLP in Pasadena.  A graduate of Harvard College and UCLA School of Law, Ms. Teukolsky clerked for the Honorable Harry Pregerson on the Ninth Circuit Court of Appeals and the Honorable A. Howard Matz at the U.S. District Court for the Central District of California before embarking on a career dedicated to public interest law and social justice.

Hernaldo J. Baltodano worked with Ms. Teukolsky when they were both associates at Hadsell & Stormer, Inc.  More recently, Ms. Teukolsky has served as co-counsel in two high-profile employment cases with Erica Flores Baltodano and Hernaldo J. Museum Artists Find Permanent Home at Baltodano & Baltodano LLP

Baltodano & Baltodano LLP has been a proud supporter of Art About Town, a unique partnership between San Luis Obispo County businesses and Central Coast artists, whereby local artists display their works in public buildings and private offices, since 2012.  Most recently, our office hosted the artwork of Melvin and Patricia Dorin, married photographers who, in their retirement, have exhibited nationally and at the San Luis Obispo Museum of Art, where they recently earned Best of Show for one of their images of Moonstone Beach in Cambria. 

Our staff and clients enjoyed the Dorins’ photographs so much we decided to keep them—they have a permanent home in our Downtown San Luis Obispo office and are also featured throughout our website.

Mr. and Mrs. Dorin frequently visit local beaches where their fading footprints follow them along the water’s edge.  They photograph the things they encounter that have been delivered by the waves and the receding tide—driftwood, seawed, and other living matter that wash up on the shore.  According to the artists, their photographs “are records of history.   The subjects exist for the briefest of moments, only until the next tide, or the next winter storm.  Like ours, their footprints fade away and then are gone.”

We are honored to showcase the intricate and colorful collection of photographs by Melvin and Patrcia Dorin at our office and on our website.   The photographs are intriguingly complex, but peacefully simple.  The artists consider their photographs “a celebration of the beauty and fragility of life and an appreciation of the journeys we make from here to who knows where.”  We couldn’t agree more.

Nurses Sue Twin Cities Community Hospital for Breaks & Wage Theft

On March 30, 2015, eight nurses filed a lawsuit in San Luis Obispo Superior Court against Twin Cities Community Hospital for rampant wage-and-hour violations, including wage theft and an across-the-board failure to provide breaks. The Hospital is a 122-bed acute care facility located in Templeton. It has an emergency room and provides a broad array of medical, surgical and outpatient services. The Hospital is owned by Tenet, the second-largest employer in San Luis Obispo County. On Display Now: See the World Through the Creative Eyes of Photographer Cat Evans

What began as way to record images of her children and moments with her family has turned into a serious hobby we can all appreciate and enjoy. Baltodano & Baltodano LLP is currently hosting the artwork of photographer Catherine “Cat” Evans as part of the San Luis Obispo Museum of Art’s Art About Town program.

Ms. Evans says “Over the years I began to notice the details in the world around me and my photographic eye was, and continues to be, inspired.”  The Central Coast of California has been a place of inspiration for Ms. Evans that lends itself to photography and it has been her pleasure for years to document beauty in the local landscape, as well as those magical places she visits on her many travels abroad.

The Magic of Light: The Stunning Work of Award-Winning Photographer Cheryl Strahl on Display now at Baltodano & Baltodano LLP

Baltodano & Baltodano LLP has proudly supported the San Luis Obispo Museum of Art (SLOMA) since 2012 when we began participating in Art About Town, a unique partnership between San Luis Obispo County businesses and Central Coast artists, whereby local artists display their works in public buildings and private offices.  Today, we are thrilled to host the stunning work of award-winning photographer Cheryl Strahl.

After a career in software  engineering, Ms. Strahl turned to her passion for capturing and processing photographs that reflect the beauty she sees in the world.  “Light is my guide.  Where it leads, I follow—camera in hand—as it paints color and shadow, emphasizes lines and shapes, shifting its magic from moment to moment,” explains Ms. Strahl.  Her work reflects her travels, both locally in San Luis Obispo County and Yosemite National Park, and further afar in colorful places like Costa Rica and Alaska.  Images from Ms. Strahl’s striking collection are on display and available for sale in our San Luis Obispo office now through February, 13 2015.

UPDATED: In A Published Opinion CA Court of Appeal Issues Favorable Decision Benefiting California Nursing Assistants: Baltodano & Baltodano LLP Lawsuit to Move Forward in SLO County Court

In August 2011, John Castañeda, a certified nursing assistant, sued his former employer, The Ensign Group, Inc., for wages he never received while working at Bella Vista Transitional Care Center (formerly Cabrillo Rehabilitation and Care Center) in San Luis Obispo, California.  The Ensign Group, Inc. operates various cluster companies and subsidiaries, which, in turn, operate skilled nursing facilities throughout California.  Mr. Castañeda brought a state-wide class action lawsuit to recover unpaid wages on behalf of thousands of certified nursing assistants who work at defendants’ skilled nursing facilities across California.

After the San Luis Obispo Superior Court threw out Mr. Castañeda’s case on the ground that The Ensign Group is not an “employer” and, therefore, not liable for unpaid wages, Baltodano & Baltodano LLP, working with appellate attorney Allison Ehlert from Ehlert Appeals, appealed the ruling.  “We intend to challenge The Ensign Group’s business model.  A large corporation simply cannot cheat workers out of wages and evade liability by hiding behind other companies and subsidiaries it owns,” said attorney Hernaldo J. Baltodano.

On August 7, 2014, the California Court of Appeal reversed the trial court’s ruling, holding that triable issues of material fact exist as to whether The Ensign Group is an employer and liable for the unpaid wages.  The decision succinctly elaborates on the definition of “employer” set forth in the California Supreme Court’s seminal decision in Martinez v. Combs.  Ms. Ehlert said, “The appellate decision is unequivocal.  We amassed a huge amount of evidence showing The Ensign Group was Mr. Castañeda’s employer, we met our burden on appeal, and now Mr. Castañeda will have his day in court.”

UPDATE: On September 15, 2014, the Court of Appeal certified its opinion in the Ensign case for publication, making it a permanent part of California’s body of employment law that can be cited by other attorneys in future cases.  Baltodano & Baltodano LLP and several California plaintiff-side law firms recommended publication because of the impact the decision will have on similar wage and hour lawsuits and the clarity it brings to an otherwise little discussed aspect of employment law post-Martinez v. Combs.

Castañeda v. The Ensign Group now returns to San Luis Obispo Country Superior Court.  We look forward to moving for class certification and trial in the months ahead.  To read the full opinion by the California Court of Appeal, which has now been certified for publication, please click here.
