Baltodano & Baltodano LLP Sues Albertson’s Supermarket for Failure to Accommodate Atascadero Employee’s Pregnancy, Leading to Baby’s Death
Baltodano & Baltodano LLP has filed a lawsuit against Albertson’s Supermarket for failing to accommodate an Atascadero woman’s pregnancy-related disabilities, which caused her to go into labor when she was twenty weeks pregnant and give birth to a baby girl who died minutes later at Twin Cities Hospital in Templeton in 2012.
“At a minimum, the law requires employers to meet with an employee who requests a medical accommodation to determine whether the employee’s medical needs can be addressed,” said employment attorney Erica Flores Baltodano. “There were many things Albertson’s could have done to accommodate Ms. Garcia, but they didn’t even try.”
