Nearly 50% of 2017 is Over, But Baltodano & Baltodano LLP Remains 100% Committed

It is hard to believe that nearly half of 2017 is over, but it shouldn’t be surprising to hear that Baltodano & Baltodano LLP has already made a tremendous impact on our community.  While maintaining a full caseload of contingency-based and pro bono individual and class action lawsuits on behalf of employees, we remain committed to one of our founding missions: to enrich the communities in which we practice law through education and civic service.

Founding Partners Erica Flores Baltodano and Hernaldo J. Baltodano have collectively given several keynote addresses and classroom lectures this year and have served as panelists and moderators at numerous legal and educational forums. Farewell & Congrats to Lauren Teukolsky Who Has Left Baltodano & Baltodano LLP to Open A New Firm

Effective June 1, 2017, Lauren Teukolsky has left Baltodano & Baltodano LLP to start her own firm, Teukolsky Law, A Professional Corporation.  Ms. Teukolsky will continue practicing plaintiff-side employment law and remain involved in some existing Baltodano & Baltodano LLP cases as co-counsel.

We are thrilled for Ms. Teukolsky and wish her all the best.  Her departure from our firm will coincide with the closure of Baltodano & Baltodano LLP’s Pasadena office.  Conveniently, Ms. Teukolsky’s new firm will occupy the Pasadena office space previously used by our firm.

SLO Legal Assistance Foundation Names Baltodano & Baltodano LLP the 2017 Access to Justice Advocate Award Recipient

San Luis Obispo Legal Assistance Foundation (SLOLAF) has recognized Baltodano & Baltodano LLP as its 2017 Access to Justice Advocate award recipient.  SLOLAF relies on community support to fulfill its mission to deliver affordable legal services.  In a recent announcement, SLOLAF expressed gratitude for the generous support of Baltodano & Baltodano LLP.

As SLOLAF noted, “Since 2011, Baltodano & Baltodano LLP has been a shining example of what it means to support access to justice. One of the firm’s core values is that everyone should, and must, have access to our nation’s system of justice and information regarding current employment rights and responsibilities.  To that end, nearly all Baltodano &  Baltodano LLP cases are handled on a contingency basis, which ensures quality legal representation for individuals who would otherwise be unable to afford an attorney.  In addition, since 2011, Baltodano & Baltodano LLP has made considerable donations to numerous local and state-wide charitable organizations and causes, including SLOLAF.”

Hernaldo Baltodano Joins FAIR Board of Directors to Promote Diversity within Plaintiffs’ Employment Bar in California

Baltodano & Baltodano LLP Founding Partner, Hernaldo J. Baltodano, has just joined the Board of Directors of the Foundation for Advocacy, Inclusion & Resources (FAIR), a non-profit organization founded by members of the California Employment Lawyers Association in 2009. FAIR’s mission is to promote diversity within the plaintiffs’ employment bar in California, so the attorneys representing California’s workers are as diverse as those they seek to represent. FAIR also seeks generally to raise public consciousness about worker’s rights and remedies, to provide educational opportunities and programs to individuals who seek to advance the rights of workers, including but not limited to fellowships, internships, and scholarships, and to carry on other educational activities associated with FAIR’s goals.

Baltodano & Baltodano LLP Proudly Supports RISE to End Sexual Assault & Gender-Based Violence

1 out of every 6 American women has been the victim of

attempted or completed rape in her lifetime.

90% of adult rape victims are female.

1 in 5 girls and 1 in 20 boys is a victim of child sexual abuse.

Children are most vulnerable to sexual abuse

between the ages 7 and 13.

10,600 military serviceman and

9,600 military servicewomen were

sexually assaulted in 2014, a rate unchanged from 2010.

These numbers are not acceptable.  That’s why, for the second consecutive year, Baltodano & Baltodano LLP is proud to be a major sponsor of Walk a Mile in Her Shoes, a series of San Luis Obispo County events organized by RISE that seek to end sexual assault and gender-based violence.

Every year, San Luis Obispo County men, women, & children Walk a Mile to raise awareness for an uncomfortable topic that affects all of us in our community.  This year, Walk a Mile events have been scheduled throughout the month of April, which is Sexual Assault Awareness Month.  The 15th Annual Walk a Mile SLO will take place from 10am-2pm on April 29, 2017, in Mission Plaza. Walk a Mile Arroyo Grande, Walk a Mile Paso Robles, and Walk a Mile Cuesta Community College were successful events that took place earlier this month.

Traditionally Walk a Mile events showcased men marching in high heels to represent the role men play in ending a form of violence that is overwhelmingly perpetrated by men against women, but participants are encouraged to walk in any type of shoe because gender-based violence affects us all—women, men, & children; members of the LGBTQIA+ community; incarcerated individuals; people with disabilities; those of all socioeconomic levels, races, & religions—people in all walks of life.

Children’s Advocacy Institute Recipient of $143,297.23 Cy Pres Award Stemming from Baltodano & Baltodano LLP Lawsuit

The University of San Diego’s School of Law’s Children’s Advocacy Institute (CAI) received a cy pres award of $143,297.23 resulting from the settlement in Lopez v. RM HQ LLC dba Real Mex Restaurants, et al.  A cy pres award is granted to a non-profit organization agreed upon by plaintiff and defense counsel as part of a class action lawsuit settlement when there are funds leftover after class members have received their settlements.

Professor Robert C. Fellmeth, Executive Director of the Children’s Advocacy Institute said “I can assure you that the funds will be spent frugally and effectively on our primary mission and core operations, which focus on leveraging positive change for children and youth through impact litigation, regulatory and legislative advocacy, research and public education.  This generous award will greatly enhance CAI’s ability to continue its efforts to improve the health and well-being of children and youth.  We greatly appreciate the time and effort expended by all of the attorneys who were involved in this matter.  We also appreciate the court’s approval of this distribution.”

Founded in1989, CAI is one of the nation’s premiere academic, research, and advocacy organizations working to improve the lives of all children and youth, with special emphasis on reforming the child protection and foster care systems and improving outcomes for youth aging out of foster care.  “Class Action settlements are complicated.  After reaching a favorable settlement on behalf of our class members, it is simply an added bonus that Defendant agreed to have unclaimed settlement funds support such a worthy organization.  Naming CAI the recipient of this cy pres award was a point of agreement by the attorneys on both sides of this case.”

Erica Flores Baltodano Joins SLO Legal Assistance Foundation Board

Baltodano & Baltodano LLP Managing Partner, Erica Flores Baltodano, has recently joined the Board of Directors of the San Luis Obispo Legal Assistance Foundation (SLOLAF).  Since 1992, SLOLAF has developed programs in San Luis Obispo that provide and promote free legal-aid services, assistance in self-representation, and conflict resolution for low and moderate-income individuals.  Currently, SLOLAF serves seniors and veterans and hopes to provide family law services soon.

Ms. Baltodano earned the prestigious Francine Diaz Memoral award for her steadfast commitment to public interest law upon graduating from UC Berkeley School of Law and then served underrepresented communities for over a decade in the non-profit legal sector before co-founding Baltodano & Baltodano LLP six years ago.  SLOLAF Executive Director Stephanie Barclay said “We are fortunate to have Ms. Baltodano and her compassionate commitment to justice and hands-on experience with non-profit management on the SLOLAF Board.”

Erica Flores Baltodano Helped Moderate Inspiring Forum on “Latinas and Education”

On Wednesday, March 22, 2017, Baltodano & Baltodano LLP Managing Partner Erica Flores Baltodano served as a co-moderator and panelist at “Latinas and Education,” a forum sponsored by San Luis Obispo’s Latino Outreach Council.

This free, educational forum was intended to empower Latinas and other members in our community.  Latina students from local high schools and Cal Poly, as well as professional Latinas, shared their challenges and keys for success. The event, which was attended by approximately 50 people, was broadcast on the county television station and will be available online and for distribution to local teachers and educators.

The “Latinas and Education” Forum was held at the County Government Center in San Luis Obispo from 5-8:30pm. The first panel of speakers focused on students and was followed by a second panel of speakers featuring an Arroyo Grande-based accountant, a school principal in Guadalupe, and the Paso Robles City Librarian.  Ms. Baltodano and  Nipomo-based attorney Jacqueline Del Valle Frederick also shared their education experiences as part of the panel of Latina professionals and moderated the Latina student panel.

Ms. Del Valle Frederick, who is the President of Latino Outreach Council, announced an effort to create a mentor program in San Luis Obispo County to further connect Latina students with professional Latinas.  “All who took part in this forum, as speakers or audience members, were greatly moved,” Ms. Baltodano said.  “I was particularly impressed by the student panelist who shared their very personal– and still raw– stories of struggle with grace and bravery. They are an inspiration to all of us.”

Hernaldo Baltodano to Address School District Parents & Students: Know Your Rights

On February 16, 2017, Hernaldo J. Baltodano will be part of a panel of attorneys and others who will address parents and students in the San Luis Coastal Unified School District (SLCUSD) about their rights as employees and immigrants.  The panel, organized by the principal of Pacheco Elementary School and open to all SLCUSD families, will include representatives from the Mexican Consulate’s office, U.S. Congressman Salud Carbajal’s office, and immigration attorneys familiar with up-to-date changes in U.S. immigration policy.  Mr. Baltodano will specifically address workplace issues related to documented and undocumented employees.  Click here for more information in English and Spanish.

In December 2016, San Luis Coastal Unified School District adopted a School District Safe Zone resolution to reassure school children and their families that our public schools are safe places where they will not be questioned regarding their immigration status and where they can obtain information or assistance if faced with fears or anxiety related to immigration enforcement efforts.  The February 16 “Know Your Rights” workshop is consistent with the school district’s Safe Zone resolution.

Immigrant families are feeling anxious right now and it is important for them to know their legal rights in the workplace– rights that apply regardless of their immigration status– as well as their rights as documented or undocumented immigrants. “Baltodano & Baltodano LLP is honored to play to a role in this educational workshop for families who are feeling particularly vulnerable at this time,” said Erica Flores Baltodano who coordinates the firm’s strong commitment to education, civic service, and charitable giving.

Hundreds of families are expected to attend the school district event on February 16, 2017.
